End User Licence Agreement

We grant you a personal, non-exclusive, non-transferable licence to install and use the Software on computers you own or are authorised to use, to move your data from one Windows computer to another. The Software is licensed, not sold.

The free plan lets you run migrations of up to 11 GB each. A paid licence covers one migration (one source computer to one destination computer) of the size of the plan bought, and may be resumed or retried for the period shown at purchase. Retailer, business and enterprise plans follow the terms of the account or contract they were bought under. Licence keys are for the buyer's use and must not be shared, sold or published.

You may not: copy or distribute the Software except as this Agreement allows; reverse engineer, decompile or disassemble it, except to the extent the law allows despite this restriction; remove or bypass licence checks, signatures or security features; use the Software to copy data you are not entitled to copy; or use it in breach of any law.

Your files move directly between your two computers over an encrypted connection; they are not uploaded to OthTech. The Software never deletes data from your old computer. It does not move installed programs, Windows itself, drivers, licences or saved passwords. You are responsible for keeping your old computer and its data until you have checked your data on the new one.

The Software checks licences and updates with OthTech's servers. If you sign in, it links migrations to your account and reports their result (counts, sizes and status, never file contents or names). Anonymous usage statistics are sent only if you turn them on in Settings, and can be turned off at any time. Diagnostics files are sent to support only when you choose to send them, after you have seen what they contain. Our Privacy Policy explains this in full.

The Software may download and install updates, including security fixes. Updates are signed by OthTech and checked before they are installed. This Agreement applies to updates unless they come with a different agreement.

OthTech and its licensors own the Software and all intellectual property in it. Third-party open-source components are licensed under their own licences, listed in the Software's About screen.

Refunds follow our Refund Policy. If a purchase is refunded, its licence stops working for future migrations; files already moved are never touched. You may end this Agreement at any time by uninstalling the Software. We may end it if you seriously breach it. Sections 7, 9, 10 and 11 continue after it ends.

We work hard to make the Software reliable and to verify every file it moves, but the Software is provided "as is" to the fullest extent the law allows. We do not promise it will be error-free or uninterrupted. Nothing in this Agreement limits rights you have as a consumer that cannot be limited by law.

To the fullest extent the law allows, OthTech is not liable for indirect or consequential loss, or for loss of data that you could have avoided by keeping your old computer as the Software advises. Our total liability under this Agreement is limited to the amount you paid for the licence concerned. Nothing limits liability that cannot be limited by law.

This Agreement is governed by the laws of India, and the courts of India have jurisdiction over disputes about it.
